I could definitely see the FanLib fee happening. They have the advantage of industry connections that fan-run sites do not. In order to get to that point however, they would need to send out C&D's until they found someone who would fight. Then we'd have the definitive ruling on fanfic that we've all been dreading/hoping for. With FanLib in existence, the ruling could very well be in the copyright holders' favor.
