yeah, that's very true.

but the law doesn't set up any fee system, tho.

so they'd need to establish one. that means a new law.

why bother with state court cases... then federal court cases... then supreme court cases (which cost money), when they could simply lobby congress (which is, in essence, free -- actually there might be a fee) for a new law?

either way, i definitely agree that the end result will be a more clear definition of 'fair use', but i don't think they're going after just fanfic, rather ALL published works.

there's definitely an attack on 'printed/published' words on the horizon.
