I think that this will end up in a test case before the Supreme Court and that the slashers will lose. I'm curious what percentage of the fanfiction market are slashers?
i think a 'test case' is needed only to better define the parameters of a current law.
as in: the law states this, we believe fanfic falls under it... well, we don't.. sue sue sue.
a fee system would be something new that they could offer Congress, gain some support with Publishers, and go from there. a new law would come into place that either enhances the current law, or supersedes it.
